Because the ability to pursue happiness is about the best you can expect a government to be able to provide. Happiness cannot be assured, even if you have all the things you want you could still be unhappy.

You're thinking about this all wrong. The Declaration of Independence isn't a binding document; it's an ideal suggestion. The US Constitution is the operating rights document. "Happiness" doesn't appear once in that.
